For overseas tours, if the amount is determined in foreign currency, the exchange rate used in payment shall be the rate accepted by the parties at the time of sale. ARTICLE 5 - RIGHT OF WITHDRAWAL Pursuant to Article 15/1-g of Law No. 6502 and the Distance Contracts Regulation, the BUYER HAS NO RIGHT OF WITHDRAWAL in contracts for accommodation, goods transportation, car rental, food and beverage supply, and leisure or recreational activities to be carried out on a specific date or period. Package tour agreements fall within this scope. However, the BUYER may benefit from the cancellation, transfer and termination conditions regulated in Article 6 below. ARTICLE 6 - CANCELLATION, TRANSFER AND TERMINATION CONDITIONS ____________ The BUYER may transfer their reservation to a third party who fulfills all valid conditions for the package tour by giving written notice to the SELLER at least seven (7) days before the tour starts. Both the transferor and transferee are jointly liable for the remaining amount and expenses arising from the transfer. The SELLER may cancel the tour in case of necessity (failure to reach minimum number of participants, force majeure); in this case, the amount paid by the BUYER shall be refunded. ARTICLE 7 - GENERAL PROVISIONS 7.1 The BUYER accepts that they have read the preliminary information regarding the fundamental specifications of the service subject to the agreement, sales price and payment method, and information about performance, and have provided the necessary confirmation in electronic form. 7.2 The BUYER accepts that the identity and contact information provided during the reservation is correct; and that any liability arising from incorrect or incomplete information is their responsibility. 7.3 The provision of passport, visa and health requirements is the responsibility of the BUYER. 7.4 Information regarding the processing of personal data has been provided through the separately presented KVKK Disclosure Text and Express Consent Declaration. ARTICLE 9 - EFFECTIVE DATE This agreement becomes effective upon approval by the BUYER in electronic form. A copy of the agreement shall be sent to the BUYER through a permanent data storage medium. Parties This agreement is concluded between GEZİHANE TOURISM AND TRAVEL AGENCY (hereinafter referred to as "GEZİHANE"), which operates the activities of the website www.gezihaneturizm.com and is domiciled in Nilüfer/BURSA, and the internet user who is a member of the website www.gezihaneturizm.com (hereinafter referred to as "MEMBER/USER"). 2. Subject Matter of the Agreement The subject of this agreement is to determine the conditions for members' benefit from the website www.gezihaneturizm.com owned by GEZİHANE. This agreement shall apply to all vacations, tours, airline tickets, car rentals and other services used by the member during the term of the agreement. 3. Rights and Obligations of the Parties The user guarantees the accuracy of the information provided when registering on the site and is responsible for all obligations arising from this information. Furthermore, the user accepts to comply with the laws, agreement provisions and other announced rules when using the site. 10. Intellectual Property Rights The design, content and all software of www.gezihaneturizm.com belong to GEZİHANE. Copying, modification or commercial use without permission is prohibited. 11. Termination of the Agreement This agreement terminates if the user requests the cancellation of membership or if GEZİHANE terminates the membership due to non-compliance with membership rules. 12. Dispute Resolution In any disputes arising from this agreement, the courts and enforcement offices of Bursa are competent. 13. Effective Date This agreement is deemed accepted and comes into effect when the user becomes a member of www.gezihaneturizm.com.
